Edward George Kitney, aged 30 years, was charged with having assaulted a girl under the age of 14 years. The accused, who was represented by Mr. E. R. Abigail, grinned in a peculiar manner when asked to plead. He had been remanded from the last Quarter Sessions on the ground that he was mentally unlit to plead.
Proceedings had not been far advanced on Monday when his Honor decided to postpone the matter, so that the Government Medical Officer might have an opportunity of examining the man. '
Dr. A. A. Palmer now explained that the ' accused was a harmless imbecile, and had probably been so from birth.
The jury, having heard the evidence of the father, Robert Kitney, decided that the accused was mentally unlit to plead, and they were discharged.
His Honor ordered tho accused to be detained in Darlinghurst Gaol until such time as an application was made under the Lunacy Act. "It would, of course," added the Judge, "be open for the man's people to apply for his custody under the provisions of the Act." on 16 February 1909 at Sydney, New South Wales. He died in 1948 at Granville, NSW; Reg no. 11985/1948 or Gore Hill.
